Terms of Service

1. Agreement

These Terms of Service ("Terms") are an agreement between you and ProdPush ("ProdPush", "we", "us") governing your access to and use of the hosted ProdPush service available at prodpush.app and its subdomains (the "Service"). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to it.

2. The Service and the open-source software

ProdPush is also available as open-source software under the GNU Affero General Public License v3.0 (AGPL-3.0). These Terms apply only to the cloud Service we host. If you self-host ProdPush, your use of the software is governed by the AGPL-3.0 license, not these Terms, and we provide no service, support, warranty, or liability of any kind for self-hosted deployments.

3. Your account

• You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account.
• You must be at least 16 years old (or the minimum age required in your jurisdiction) to use the Service.
• Notify us promptly at [email protected] if you suspect unauthorized use of your account.

4. Your content

You retain all rights to the issues, documents, files, and other material you or your team submit to the Service ("Customer Content"). You grant us a limited, non-exclusive license to host, store, process, transmit, and display Customer Content solely as needed to provide and improve the Service. You are responsible for your Customer Content and for ensuring you have the rights to submit it.

5. Acceptable use

You agree not to: (a) use the Service for unlawful purposes; (b) attempt to gain unauthorized access to systems or other customers' data; (c) probe, scan, or test the vulnerability of the Service without written permission; (d) interfere with or disrupt the Service, including by imposing an unreasonable load; (e) transmit malware or infringing, defamatory, or otherwise unlawful material; or (f) resell or provide the Service to third parties as a service bureau without our written consent.

6. AI features

The Service includes AI-powered features (such as agents, automations, and knowledge answers). AI output may be inaccurate, incomplete, or misleading. AI output is provided for convenience only, does not constitute advice, and you are solely responsible for reviewing and verifying it before relying on it or taking action. AI features may be modified, rate-limited, or withdrawn at any time.

7. Availability, changes, and data

The Service is under active development. We do not guarantee that the Service will be uninterrupted, timely, secure, error-free, or free of defects, or that data loss will not occur. We may add, change, or remove features at any time. You are responsible for maintaining independent backups of Customer Content that is important to you (export features are provided where practical). We will make reasonable efforts to preserve your data, but the Service is not a system of record or an archival service.

8. Fees

Parts of the Service may be offered free of charge and parts under paid plans. Prices, plan limits, and free-tier scope may change with reasonable notice. Fees, where applicable, are non-refundable except where required by law or expressly stated otherwise.

9. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR THAT DEFECTS WILL BE CORRECTED. YOU USE THE SERVICE AT YOUR OWN RISK.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) IN NO EVENT WILL PRODPUSH, ITS OPERATORS, CONTRIBUTORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, USE, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (b) OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR FIFTY U.S. DOLLARS (US $50).

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you; in that case our liability is limited to the smallest extent permitted by law.

11. Indemnification

You will defend, indemnify, and hold harmless ProdPush and its operators from and against claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Customer Content, your use of the Service in violation of these Terms, or your violation of applicable law or third-party rights.

12. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you materially breach these Terms, if required by law, or to protect the Service or its users. Where practical, we will give you a reasonable opportunity to export Customer Content after termination, except in cases of serious abuse or legal prohibition.

13. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will give reasonable notice (for example, by email or an in-app notice). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles, and the courts of New Delhi, India shall have exclusive jurisdiction over disputes arising from these Terms or the Service, except where mandatory consumer law in your country of residence provides otherwise.
